  2. Well shouldn't the state or the county pay the fees? Davis was acting in an official capacity.

    U.S. Magistrate Judge Edward B. Atkins signed an order Monday that says because the issue was resolved in the legislature the plaintiffs weren't prevailing parties and therefore are not entitled to legal fees.

    That is some Grade-A bullshit. [sigh]

    1. Also, the legislature hadn't acted to take clerk's names of the certificates at the time the plaintiffs sued.
