A spokesman for Mike Lee (R-Utah) is saying the Senate is likely to try to block anyone Obama nominates to let the next president pick. They want a non-functional Supreme Court for an entire year. This is suddenly going to be the biggest campaign issue. It should have been anyway but now it's out in the open.
I'm sure they will give that a good go for a couple-few months until it totally blows up in their face, making them look like obstinate babies (AGAIN). Also, that means they cannot take a single recess until the inauguration, since it's valid to do recess appointments for SCOTUS (that's how Eisenhower got William Brennan on the court). So I really don't think they can sustain it.
So they have to keep Congress in session for 11 months… when most are likely to be paying attention to campaigning, even if they're not up for election in 2016? This is going to be amazing.
Also, of the current court, the longest it took to get any of them approved was Thomas, at 106 days. No way can the Congress creatures make good on this threat (I'd say without looking like jackasses, but I think they will not only fail to block, they will also look like jackasses).
