  1. WASHINGTON — The Supreme Court on Monday struck down parts of a restrictive Texas law that could have reduced the number of abortion clinics in the state to about 10 from what was once a high of roughly 40.

    Justice Stephen G. Breyer wrote the majority opinion, joined by Justices Anthony M. Kennedy, Ruth Bader Ginsburg, Sonia Sotomayor and Elena Kagan. Chief Justice John G. Roberts Jr. and Justices Clarence Thomas and Samuel A. Alito Jr. dissented.

    5-3 decision. I guess we don't need that SCOTUS justice replacement after all. (Totally kidding, I wish the fuckheads in Congress would get off of their asses.)

    Great bit noticed by a SCOTUSblog reader: the Fifth Circuit said that a court couldn’t hold that HB2 was facially unconstitutional, because the plaintiffs only asked for as-applied relief. Breyer’s response was basically, “Oh yes you can – remember Citizens United?”

    Following the death of Justice Anontin Scalia, who likely would have voted to uphold the law, many observers expected the court to deadlock in this case along ideological lines. For abortion providers, this was a kind of doomsday scenario: A split would have upheld the fifth circuit court of appeals decision of June 2015 and forced half of Texas clinics to close.

    So if Fat Tony hadn't gone off to that Great Hunting Lodge in the Sky, those TRAAP laws probably would have survived?
